within the Community.

The decision requires the French authorities to adopt

measures allowing Community carriers access to the route in

COMMISSION RULES ON COMPLAINT LODGED BY TAT (PARIS-MARSEILLE, PARIS-TOULOUSE)

The Commission has decided that the French authorities can

no longer refuse to allow Community air carriers to exercise

traffic rights on the Paris-Marseille and Paris-Toulouse

routes operating from Orly airport. The Commission's

decision, which will be published in the Official Journal of

the European Communities, is in response to a complaint

lodged with the Commission by the French company TAT

European Airlines in September 1993.

The French authorities intended to maintain the exclusive

concession to operate services on these two routes using

Orly airport currently granted to the company Air Inter. The

operation of services on these routes using the Charles de

Gaulle airport is already open to all Community carriers.

The Commission considered that the maintenance of an

exclusive concession for flights from and to Orly airport

constituted discrimination in favour of the company Air Inter

and that it was an indirect form of traffic distribution within

the Paris airport system.

The decision requires the French authorities to adopt

measures allowing Community carriers access to the routes

in question within six months.
